In the current state of ET, if an opponent doesn't mind a bit of rulebending, who am I to say no? haxbyjam was free to contact me about this issue then the mercs wouldn't have been allowed, but they didn't. So all is good.

It's in the rules. Everyone is free to plead for a particular rule. I'd rather have the match played too, but in this case it's up to SSTAT to decide because it's in the rules. Sorry :)
